Complex, but solvable

IT Procurement Law

Formalised game
The public sector procures IT services through formalised procurement procedures. Even small errors can have far-reaching consequences. Bidders are threatened with exclusion from the award, while the awarding authority is threatened with a review of its award procedure by the Public Procurement Chamber. Awarding authorities and bidders are therefore well advised to adhere to the legal rules of the game.

IT compliance as a foreign word
Many people talk about IT compliance, but many don't know what it means exactly. The dictionary defines compliance as "observance, adherence, fulfilment, consent." For companies, it is a matter of adhering to the relevant laws. But it also concerns recognising risks in advance – introducing appropriate control systems.

Avoid the consequences of damage
These days, failure by corporate IT departments due to lack of preparedness is no longer an incident that is simply accepted. Since processes are networked, the consequences of damage can quickly reach considerable heights. Accordingly, company and IT management can be sued for damages. But this liability can be averted.

The pitfall of IT proceedings
Court proceedings with a focus on IT are an art in themselves: judges who otherwise deal with construction law usually have little understanding of the technical background. Accordingly, an expert is often involved in the legal dispute: thus, another actor enters the field, one who likes to create surprises. Therefore, our first priority is to do everything we can to avoid legal disputes in the first place.

Early preparation pays off
If it is no longer possible to avoid court hearings at an early stage, clients should be well prepared. Practice shows that strategic mistakes are usually made in a phase in which the solicitor still has no idea about their future client.

We therefore recommend our clients to contact us at an early stage. We will support them with their search for solutions and take the necessary steps to secure evidence and represent their interests. And of course, we will subsequently represent our client in court.
