Many years of experience
Supporting companies in the IT sector and companies in IT legal matters is not new territory for us – it has been part of our daily business since the late 1990s. We therefore have many years of industry and technical expertise.

Professional network
When it comes to technical questions and complex projects, we can also rely on a network of external consultants to find solutions for our clients that are not just legally sound.

More than IT law
Our support for companies in the IT sector is not limited to IT law, we also offer comprehensive support from a single source. We help found your own company in word and deed, in day-to-day business and also with buying and selling companies.

Contract law

Avoiding legal pitfalls
Outsourcing, cloud, procurement of hardware and software, adaptation of software solutions, maintenance and support, licenses, partnerships, waterfall or agile development – an IT project does not have to be complex to contain legal pitfalls.

Preventive regulation
In this regard, IT law comprises more than knowledge of proven legal solutions. Rather, experience shows that much more needs to be clarified in addition to legal issues. In our experience, customers and suppliers often do not speak the same language, and without a clear service description they can end up disputing many different things. We offer appropriate solutions, whereby we provide comprehensive and preventive advice.

Data Protection

Complex, but solvable
There are few other legal terms that strike greater fear into the hearts of those affected than data protection: legal requirements that rarely really fit the fast pace and complexity of business models or IT solutions and, in addition, formulations that are neither clear nor succinct, even upon the third reading. In addition, there is the GDPR, which often creates more questions than answers for those affected by it.

But those who, like us, know the territory can offer solutions that reconcile theory and practice.

We will support you with the design and review of products and websites under data protection law, with data protection impact assessments, the preparation of privacy policies or declarations of consent and with all other projects or requirements relating to data protection. There is only one thing we do not offer: We will not become your external data protection officer. However, if you are looking for a data protection officer, we can list suitable candidates.

IT Procurement Law

Formalised game
The public sector procures IT services through formalised procurement procedures. Even small errors can have far-reaching consequences. Bidders are threatened with exclusion from the award, while the awarding authority is threatened with a review of its award procedure by the Public Procurement Chamber. Awarding authorities and bidders are therefore well advised to adhere to the legal rules of the game.

We support service providers in particular and accompany them through the award procedure on the bidder side. Please contact us if you as a service provider are considering participating in an award procedure or if you need a check on compliance with the rules of procedure.

IT Compliance

IT compliance as a foreign word
Many people talk about IT compliance, but many don't know what it means exactly. The dictionary defines compliance as "observance, adherence, fulfilment, consent." For companies, it is a matter of adhering to the relevant laws. But it also concerns recognising risks in advance – introducing appropriate control systems.

Avoid the consequences of damage
These days, failure by corporate IT departments due to lack of preparedness is no longer an incident that is simply accepted. Since processes are networked, the consequences of damage can quickly reach considerable heights. Accordingly, company and IT management can be sued for damages. But this liability can be averted.

Corporate compliance also includes IT security issues, protecting corporate data from unauthorised access and much more. We support our clients in finding appropriate solutions for each of these areas.

Legal Disputes

The pitfall of IT proceedings
Court proceedings with a focus on IT are an art in themselves: judges who otherwise deal with construction law usually have little understanding of the technical background. Accordingly, an expert is often involved in the legal dispute: thus, another actor enters the field, one who likes to create surprises. Therefore, our first priority is to do everything we can to avoid legal disputes in the first place.

Early preparation pays off
If it is no longer possible to avoid court hearings at an early stage, clients should be well prepared. Practice shows that strategic mistakes are usually made in a phase in which the solicitor still has no idea about their future client.

We therefore recommend our clients to contact us at an early stage. We will support them with their search for solutions and take the necessary steps to secure evidence and represent their interests. And of course, we will subsequently represent our client in court.

Out- and Insourcing

Comprehensive support and advice
Outsourcing IT systems is nothing new. Not even for us. Be it smaller projects such as outsourcing the mail server, or larger projects such as outsourcing SAP or transferring the entire IT to an external service provider, even those who are planning a rollback and want to reinvent themselves are in safe hands with us.

When it comes to outsourcing and insourcing, we not only support clients with our legal IT expertise, we also know the pitfalls of labour and tax law.
